Sentencing delayed until late October in murder case

CHANUTE — Sentencing for a rural Parsons man convicted in a 2023 murder has been delayed until late October.

Clint Nibarger, 34, pleaded to second-degree murder and conspiracy to commit murder, both high level felonies. He originally was charged with first-degree murder and conspiracy in Neosho County District Court. He changed attorneys when the case was scheduled for sentencing earlier this year, which has caused case delays.

His wife, Kimberly Jean Nibarger, 49, received just over 10 years in prison for conspiracy to commit first degree and another felony. Deputy Kansas Attorney General Jessica Domme requested restitution of $5,230.88 from Nibarger and her husband, Clint, if his conviction stands. The recommendation was that 25% of Kimberly Nibarger’s earnings while in prison be applied to restitution. The Neosho County Sheriff’s Office also requested reimbursement for $2,895 for medical expenses incurred by Kimberly Nibarger while in jail.

The Nibargers are accused of fatally shooting Dakota Patton, who was last seen alive with the Nibargers on April 25, 2023, at Pete’s in Parsons. Patton’s body was found on the south side of 20th Road between Xavier and Wallace roads in Neosho County on May 8, 2023.

Clint Nibarger told a friend in Hollister, Missouri, that he had shot Patton in the face.

Nibarger’s current attorney, Forrest Lowry, had previously requested a new setting in the case so he could address his client’s unanswered questions.

This week, Lowry said he was not ready to conduct sentencing and asked for another 30 days.

Nibarger will be sentenced at 1:30 p.m. Thursday, Oct. 30, in Chanute.
