A rural Parsons man will be sentenced in late August for the 2023 murder of another Parsons man, Dakota Patton.
Clint Nibarger, 34, pleaded to the lesser charges of second-degree murder and conspiracy to commit murder, both high level felonies. He was charged with first-degree murder and conspiracy in Neosho County District Court. He changed attorneys when the case was scheduled for sentencing earlier this year, which has caused delays in his case.
His wife, Kimberly Jean Nibarger, 49, received just over 10 years in prison for conspiracy to commit first degree and another felony. Deputy Kansas Attorney General Jessica Domme requested restitution of $5,230.88 from Nibarger and her husband s, Clint, if his conviction stands. The recommendation was that 25% of Kimberly Nibarger’s earnings while in prison be applied to restitution. The Neosho County Sheriff’s Office also requested reimbursement for $2,895 for medical expenses incurred by Kimberly Nibarger while in jail.
The Nibargers are accused of fatally shooting Patton, who was last seen alive with the Nibargers on April 25, 2023, at Pete’s in Parsons. Thomas and Nibarger wed soon after.
Clint Nibarger told a friend in Hollister, Missouri, that he had shot Patton in the face.
Earlier this month, Clint Nibarger was to have a status hearing. However, that was delayed because his attorney, Forrest Lowry, requested more time to deal with his client’s unanswered questions.
The case is now scheduled for sentencing and a motion at 1:30 p.m. Tuesday, Aug. 26, in Chanute.
