Man convicted of aggravated domestic battery picks up new stalking charge

A judge rescheduled sentencing for a Parsons man who pleaded to three domestic violence charges after new a new charge alleged the man stalked the same woman and violated a protection order.

Justin A. Alvarez, born in 1989, 1401 Chess, pleaded guilty in early April in Labette County District Court to amended charges of aggravated domestic battery, stalking, both felonies, and criminal restraint, a misdemeanor.

Alvarez is looking at probation instead of prison time based on the plea agreement.

The amended complaint alleges that on Oct. 6, 2024, Alvarez impeded the breathing or circulation of a woman with whom he had a dating relationship. The stalking and restraint charges alleged those criminal actions on the same date.

During his plea, Alvarez’ attorney, Kyle Fleming, said his client did not have a criminal history, which means he would be eligible for probation under Kansas law. The plea requires Alvarez to complete the batterer’s intervention program within 60 days, receive a drug and alcohol evaluation and follow its recommendations and remain on house arrest with GPS monitoring until sentencing. He is also to refrain from contacting his former girlfriend.

Alvarez was to be sentenced Monday. However, the county attorney filed the new complaint alleging felony stalking, with the two incidents occurring within weeks of Alvarez taking the plea. He remained under house arrest with GPS monitoring.

In the new case, Alvarez faces a single count of stalking alleging incidents on April 23 and 24. Fleming told Judge Steve A. Stockard that the incidents appear to be chance encounters on the street. Stockard ordered Alvarez’ $50,000 bond revoked in the original case and remanded him to the custody of the sheriff until a hearing Tuesday morning.

On Tuesday, Stockard noted that he had reviewed both probable cause affidavits in the new case. He reinstated Alvarez’ $50,000 bond in the first case and set bond at $15,000 in the stalking case. He ordered house arrest with GPS monitoring plus no work release for Alvarez.

Alvarez will return to court on June 24 for a status hearing.
